How To Select A Patent Lawyer?

By Albert Martin

When you are considering getting patents, it is essential to identify and employ a good patent lawyer right at the beginning rather than only after an infringement takes place. A lawyer will, to begin with, offer advice on acquiring the patent, tell the client how to protect his patent from unscrupulous people and in case of infringement, represent the patent holder legally in court.

The patent filing and registration process is generally a very long drawn and arduous one. A patent lawyer will be of great help in this process. But, before you select a lawyer, you need to ensure that the person has comprehensive understanding of the processes involved, and is also familiar with the invention. A lawyer who has an unrelated education from the focus of your patent, may not be able to correctly help you in patenting your idea.

Another fact that the inventor should pay attention to before employing a patent lawyer is his performance record in successful grant of patent applications. If you can review information about how many patents that have been granted to clients of the lawyer then you will have a good idea of his capabilities. By doing this, you can assess how capable the lawyer is and if you have a high likelihood of success in your patent application since only a competent patent lawyer can ensure that your application does not have any errors.

With a growing number of young lawyers working in the field of patents these days, it is not difficult to find one who is right for your invention and whose fees will be well within your scope.

Moreover, you must ensure that unless there are any grave lapses on part of the lawyer in dealing with your patent, you continue with the same lawyer from the filing stage to any later disputes that might turn up with respect to your patent as he or she would have the most comprehensive knowledge of the patent in question.
